contract issued by AXA Equitable as a funding vehicle for their qualified
retirement plan. In the event that a conflict arises between the terms of your
group annuity contract and the information presented in this website the terms of
your group annuity contract will govern. To log in you will need your user ID
and password which was distributed by AXA Equitable, and for which you are
solely responsible for protecting from any unauthorized use.
Information you submit through our Web site, as well as the information we
send back to you while you are visiting our Web site, is protected while
passing through the Internet using encryption technology ("scrambling" to
make it incomprehensible) when necessary. Although AXA Equitable will use all
reasonable efforts to safeguard the confidentiality of your data and information,

SECTION 404(c)
Under Section 404(c) of the Employee Retirement Income Security Act of
1974, as amended ("ERISA") a plan fiduciary can be relieved of certain
responsibility for participant decisions regarding the investment of assets
in their accounts in a retirement plan. To obtain such relief, a plan must be
Section 404(c) compliant.
A plan that complies with the requirements of Section 404(c) is one that,
among other things provides an individual account for each participant and
permits a participant to exercise independent control over the assets in
his/her account by choosing among a broad range of investment alternatives,
and must supply participants with sufficient information to make informed
investment decision.
As the plan fiduciary, you are responsible for making certain that your
plan complies with ERISA Section 404(c) requirements, which includes, among
other requirements, providing information to participants regarding the
investment of the assets in their accounts prior to enrollment in your plan
which is funded with a Momentum group variable annuity contract.
