SECTION 404(c)
Under Section 404(c) of the Employee Retirement Income Security Act of 1974, as amended ("ERISA") a plan fiduciary can be relieved of certain responsibility for participant decisions regarding the investment of assets in their accounts in a retirement plan. To obtain such relief, a plan must be Section 404(c) compliant.

A plan that complies with the requirements of Section 404(c) is one that, among other things provides an individual account for each participant and permits a participant to exercise independent control over the assets in his/her account by choosing among a broad range of investment alternatives, and must supply participants with sufficient information to make informed investment decision.

As the plan fiduciary, you are responsible for making certain that your plan complies with ERISA Section 404(c) requirements, which includes, among other requirements, providing information to participants regarding the investment of the assets in their accounts prior to enrollment in your plan which is funded with a Momentum group variable annuity contract.
